Terms of Use and Licence for the Use of Server "trace4you.com"

1. Preliminary Remarks
Falcom Wireless Communications GmbH -FALCOM - offers by means of www.trace4you.com purchasers of certain EVALKITS (see Ordering Guide), optionally and free of charge access to the Falcom Demo Tracker Server - SERVER - as well as the Demo Tracking Software - SOFTWARE - installed there for the two test devices enclosed in the EVALKIT. Pre-condition for the permission to this use is the acquisition of the EVALKIT and the acceptance of these Terms of Use and Licence as well as the consent for the temporary storage of the data stated in the Data Protection Declaration by the USER. The access is not allowed with TEST DEVICES any other than contained in the EVALKIT.

2. User Concession
FALCOM allows the USER to make use of the SERVER as well as the SOFTWARE in order to define the position of the TEST DEVICES acquired by him, as well as allowing the use of the Operation and Information facilities planned by FALCOM. The use of the Server for devices other than the TEST DEVICES is explicitly not allowed.
The Server and its installed SOFTWARE may exclusively be used for testing and demon-stration purposes. Any other use, especially the direct, commercial use against payment as well as the support of security technical measures, especially such of accident rescue, also such of surveillance of persons with or without special permission of the persons un-der surveillance, are not allowed.

3. Conditions for Access
The access takes place by means of an access code attached to the EVALKIT. The USER is obliged to state the correct data required for the access to the SERVER, this applies especially to his e-mail address. After successful input of the data the user will receive his final access code by e-mail.

4. USER'S Duties
The USER is obliged to take proper care of the access data to the SERVER designed for him and not to make same available to third parties. FALCOM is not responsible for dam-ages which might occur due to failure in this obligation. In the reverse case the USER will indemnify FALCOM from all costs, which might occur to FALCOM due to USER'S inaccu-rate statement of data. In case the USER arranges by permission access to the Server for third parties, the USER will take care, that the access data required will exclusively be forwarded to the specified third party. In this case the USER is obliged to point out, that pre-condition for the use of the Server is the acceptance of these Terms of Use and Licence.

5. Copyright
The USER is hereby specifically made aware of the fact that copying, alteration - espe-cially the decompilation or change of the source code - of the SOFTWARE is not permit-ted. The same applies to the MapTP Software and the maps and/or pictures made avail-able by Mapsolute, which are accessible by the USER by means of www.trace4you.co within the Framing-Technology. The USER is specifically made aware of the fact that the right to use the MapTP Software and the maps and/or pictures installed under www.trace4you.com is limited only to the contractually provided purpose. No further right to use does exist, especially it is not permitted to copy the maps and/or pictures neither as hard copies.
As far as the USER and/or authorized third parties desire to make use of the MapTP Software and the maps and/or pictures installed on the SERVER beyond the extent stipu-lated under item 2, the USER has to obtain the explicit permission by Mapsolute.

6. Period of Use
The use of the SERVER including the SOFTWARE is limited to six months. The period starts with the registration of the USER on the SERVER. An extension is not possible.

7. Cost of Licence / Fees of Usage
The use of SERVER and SOFTWARE for the agreed upon period of use is free of licence fees. FALCOM makes the USER aware of the fact, that use related costs can occur, espe-cially those accruing by making use of the GPRS, of the verbal and data communication and the communication by means of SMS for the device related information inquiry. The amount of the costs depends on the provider. The costs have to be borne by the USER.

8. Warranty
FALCOM offers the access to the SERVER exclusively for test- and demonstration pur-poses. The access to the SERVER is free of charge. Therefore an uninterrupted availabil-ity can not be assured, neither a flawless function of the SOFTWARE. Furthermore FAL-COM does not guarantee of the flawlessness and / or accuracy of detail of the map mate-rial available under www.trace4you.com .

9. Liability - Compensation
The liability of FALCOM for damages due to violation of these terms, due to violation of pre-contract duties, collateral duties, violation of third parties property rights , and for tort, will be limited to such damages resulting typically of a free of charge use of a SERVER and SOFTWARE. This does explicitly not include such damages, which occur trusting in the correctness of the information obtained from the SERVER as well as possi-bly lost earnings.
As for the rest FALCOM is liable only for intent and gross negligence also of its legal rep-resentatives and agents. A liability independent of fault is excluded. Likewise any liability by FALCOM is excluded in case the USER alters by means of the SERVER the configura-tion of the TEST DEVICE resulting in unforeseen costs for the USER or any other damage occurs.
The above limitation of liability does not apply in cases of injury of life, body or health.

10. Liability - Compensation
Access data . After finalising of the period of usage all data saved at USER's registration shall be deleted, unless there are objections due to legal regulations or official instruc-tions.

11. Civil Law and Place of Jurisdiction
The user relationship is governed by German Law with exclusion of the UN Purchase Law. For all litigations the Law Court of Meiningen is the court of competent jurisdiction.

Nutzungs- und Lizenzbestimmungen für die Nutzung des Servers "trace4you.com"

1. Vorbemerkung
Die Falcom Wireless Communications GmbH - nachfolgend FALCOM - bietet Erwerbern bestimmter EVALKITS (siehe Orderingguide), unter www.trace4you.com optional den kostenfreien Zugang zum Falcom Demo Tracker Server - SERVER - und der dort hinter-legten Demo Tracking Software - SOFTWARE - für die zwei im EVALKIT enthaltenen TESTGERÄTE an. Voraussetzung für die Befugnis zur Nutzung ist der Erwerb des EVALKIT und die Anerkennung dieser Nutzungs- und Lizenzbestimmungen sowie die Einwilligung zur vorübergehenden Speicherung der in der Datenschutzerklärung aufgeführten Daten durch den NUTZER. Der Zugang ist mit anderen, als den im EVALKIT enthaltenen TEST-GERÄTEN ist nicht gestattet.

2. Nutzungseinräumung
FALCOM räumt dem NUTZER das Recht ein, den SERVER nebst SOFTWARE zur Positions-bestimmung der von ihm erworbenen TESTGERÄTE sowie für die weiteren, seitens FAL-COM vorgesehenen Betriebs- und Informationsmöglichkeiten zu nutzen. Die Nutzung des Servers für andere Geräte als den TESTGERÄTEN ist ausdrücklich nicht gestattet.

Der Server und die darauf hinterlegte SOFTWARE darf ausschließlich für Test- und De-monstrationszwecke genutzt werden. Jede anderweitige Nutzung, insbesondere die un-mittelbare, entgeltliche kommerzielle Nutzung aber auch die Unterstützung sicherheits-technischer Maßnahmen, insbesondere solcher der Unfallrettung, aber auch solche der Personenüberwachung mit oder ohne ausdrücklicher Einwilligung der überwachten Per-son, sind nicht gestattet.

3. Zugangsvoraussetzungen
Der Zugang erfolgt über einen dem EVALKIT beigelegten Zugangscode. Der NUTZER ver-pflichtet sich, die für den Zugang zum SERVER erforderlichen Daten, insbesondere seine Email-Adresse, korrekt anzugeben. Nach erfolgreicher Eingabe der Daten erhält der Nut-zer per Email seinen endgültigen Zugangscode.

4. Sorgfaltspflichten des NUTZERS
Der NUTZER verpflichtet sich, die für ihn bestimmten Zugangsdaten zum SERVER sorgfäl-tig zu verwahren und Dritten nicht zur Verfügung zu stellen. FALCOM haftet nicht für Schäden, die infolge einer Verletzung dieser Sorgfaltspflicht erwachsen. Umgekehrt wird der NUTZER FALCOM von allen Kosten freistellen, die FALCOM infolge einer fehlerhaften Datenangabe seitens des Nutzers entstehen.

Soweit der NUTZER zulässigerweise Dritten den Zugang zu Server vermittelt, wird er da-für Sorge tragen, dass die hierfür notwendigen Zugangsdaten ausschließlich an den vor-gesehenen Dritten vergeben werden. In diesem Fall verpflichtet er sich, darauf hinzuwei-sen, dass Voraussetzung für die Nutzung des Servers die Akzeptanz dieser Nutzungs- und Lizenzbestimmungen ist.

5. Urheberrecht
Der NUTZER wird ausdrücklich darauf hingewiesen, dass die Vervielfältigung, Verände-rung - insbesondere die Decompilierung oder Veränderung des Sourcecodes - der SOFT-WARE nicht gestattet ist. Gleiches gilt für die von Mapsolute zur Verfügung gestellten Landkarten und/oder Bilder, auf die der NUTZER über www.trace4you.co im Rahmen der Framing-Technologie Zugriff hat. Der NUTZER wird ausdrücklich darauf hingewiesen, dass ein Nutzungsrecht an dem unter www.trace4you.com hinterlegten Kartenmaterial nur für die vertraglich vorgesehnen Informationsabfragen besteht. Ein weitergehendes Nutzungsrecht, insbesondere zur Vervielfältigung des Materials auch in physischer Form besteht nicht.

Soweit der NUTZER und/ oder berechtigte Dritte das auf dem SERVER hinterlegte Karten-/ Bildmaterial über den unter 2. festgelegten Umfang hinaus nutzen wollen, muss er sich die jeweiligen Nutzungsrechte von Mapsolute explizit einräumen lassen

6. Nutzungsdauer
Die Nutzung des SERVERS nebst SOFTWARE ist auf sechs Monate begrenzt. Die Nut-zungsfrist beginnt mit der Anmeldung des NUTZERS auf dem SERVER. Eine Verlängerung der Nutzungsdauer ist nicht möglich.

7. Lizenzkosten / Nutzungsgebühren
Die Nutzung des SERVERS und SOFTWARE ist für die vereinbarte Nutzungsdauer lizenz-kostenfrei. FALCOM weist den NUTZERN darauf hin, dass nutzungsabhängige Kosten, insbesondere durch die Inanspruchnahme des GPRS, der Sprach- und Datenkommunika-tion und der Kommunikation via SMS für die gerätebezogene Informationsabfrage ent-stehen können. Die Höhe dieser Kosten ist providerabhängig; die Kosten hat der NUTZER zu tragen.

8. Gewährleistung
FALCOM bietet den Zugang zum SERVER ausschließlich für Test- und Demonstrations-zwecke an. Der Zugang zum SERVER wird kostenfrei gewährt. Dementsprechend kann eine ununterbrochene Verfügbarkeit ebenso wenig gewährleistet werden wie die fehler-freie Funktion der SOFTWARE. Weiterhin übernimmt FALCOM keine Gewähr für die Feh-lerfreiheit und/oder Detailtreue des unter www.trace4you.com zur Verfügung stehenden Kartenmaterials.

9. Haftung - Schadensersatz
Die Haftung FALCOMS für Schadensersatzansprüche wegen Verletzung dieses Nutzungs-vertrages, wegen Verletzung vorvertraglicher Pflichten, nebenvertraglicher Pflichten, der Verletzung von Schutzrechten Dritter und unerlaubter Handlung wird auf solche Schäden begrenzt, mit deren Entstehung im Rahmen einer unentgeltlichen SERVER-Nutzung und Softwareüberlassung gerechnet werden muss. Hierzu gehören insbesondere nicht solche Schäden, die im Vertrauen auf die Richtigkeit der über den SERVER abgerufenen Infor-mationen entstehen sowie etwaig entgangener Gewinn.

I.ü. haftet FALCOM nur für Vorsatz und grobe Fahrlässigkeit auch seiner gesetzlichen Vertreter und Erfüllungsgehilfen. Eine verschuldens-unabhängige Haftung ist ausge-schlossen. Ebenso ist eine Haftung FALCOMS ausgeschlossen, wenn der NUTZER mittels des SERVERS die Konfiguration des TESTGERÄTES ändert und dem NUTZER dadurch un-vorhergesehene Kosten entstehen oder ein sonstiger Schaden eintritt.

Bei Verletzungen von Leben, Körper oder Gesundheit findet vorstehende Haftungsbe-grenzung keine Anwendung.

10. Datenschutz
Die Erfassung und Speicherung der Zugangsdaten (Bestandsdaten) erfolgt ausschließlich zum Zwecke der Vertragserfüllung; nach Beendigung des Nutzungsverhältnisses werden alle bei der Anmeldung als Nutzer gespeicherten Daten gelöscht, soweit der Löschung nicht gesetzliche Regelungen oder behördliche Anordnungen entgegenstehen.

11. Recht und Gerichtsstand
Das Nutzungsverhältnis unterliegt deutschem Recht unter Ausschluss des UN-Kaufrechts. Für alle Streitigkeiten aus diesem Nutzungsverhältnis ist das Landgericht Meiningen zu-ständig.
